A power of attorney (POA) is important for many reasons. Primarily, it makes your life easier,
as our lawyer can now do the due diligence without you having to be present. The
authorisation is signed by a Notary Public and as our lawyer is in the same building it makes
the process extremely smooth. You just have to bring your passport and it is done in the
blink of an eye. Our lawyer will also help you apply for a NIE (tax identification number)
which is necessary for the purchase of many things here in Spain.

To complete the purchase of your new home, you transfer the remaining amount, including
taxes and fees, to your lawyer’s client account as before.When the funds are in place, a
Letter of Purchase and Legal Notice is signed by the Notary Public. This is the final document
required by the authorities so you can be registered as the new owner. Our lawyer will then
assist you in registering as the new owner at the Land Registry and arrange contracts for
basic services such as electricity, water and waste collection. And, if you have not already,
now is the time to open a Spanish bank account so your bills can be paid automatically.
When due diligence is complete, in approximately one week to ten days after the
reservation, a private purchase contract is ready to sign. The PPC is a binding agreement that
regulates the terms of the purchase, i.e., price, what is included and the latest date for
handover, etc. At the same time as you sign the PPC you also make a down payment of 10%
of the full purchase price (minus the reservation fee). In some cases, buyers who do not
need a mortgage can skip this part and go directly to the next step. For buyers of an off-plan
property, the terms of down payments can be a little different depending on the developer,
but usually you pay 30-40% before the handover date
A reservation agreement can be made once you and the seller have agreed the price. You
pay a reservation fee of approximately 6000 euros (this can vary a little depending on the
property and circumstances) so the seller will remove the property from the market. The
reservation fee is then paid into our lawyer’s client account or directly to the developer’s
account if it is an off-plan development. Now there is time for the legal parties to exchange
documentation and for your lawyer to do due diligence before moving on to the next step.
So now you have found a property you like? Perfect! It’s time to make an offer. Generally,
there is a selling agent and a buying agent, representing the two sides. As the satisfaction
and interests of both parties is the end game, we work hard to reach a final price both buyer
and seller can agree with and feel they have a good deal.
Congratulations on the successful sale of your property!
The title deed is signed by both parties – or their lawyers – and by the
Notary Public on the day of completion. On this day the last transferred
funds are paid out to the seller and in return the buyer gets the keys to
the property. The title deed is proof that ownership of the property is
transferred to a new owner and will be registered in the Land
Registry.
There are still a few more steps before you’ve finished the paperwork,
but with the help of our agents at Nest or your lawyer the process can
be completed swiftly. The final tasks will include changing the name on
utility agreements, declarations, tax paperwork and so forth. And, of

A purchase contract is prepared stating the price, take-over date and
other pertinent facts
When selling a property, a purchase contract is required which legally
covers the ownership of the property from the seller to the buyer. In this
contract you stipulate the agreed price, conditions etc. and what date
the completion will take place. The 10% of the selling price will also be
transferred to the seller at this signing off

The common situation in a sell-purchase in Spain involves two brokers,
one representing the seller and the other the buyer. Bids between the
prospective purchaser and the seller are negotiated by the brokers in
writing as well as verbally and as soon as both parties have agreed the
lawyers will set up a reservation contract or sometimes parties go
directly to the private purchase contract.

Kitchen

remove everything you can from the kitchen sink and surfaces, including
small appliances, kitchen utensils and clean dishes. It’s preferable if you
remove photos, drawings and other items from the refrigerator. No
bottles or brushes for washing up in sight.
Living room
Clear spaces and straighten couch cushions. A clean floor gives a better
impression without rugs and makes the room look more spacious. Light all
side table lamps and decorate the room with fresh flowers. Put away tv-controls etc.
Bedroom
Make beds and put on bedspreads. Put away clothes and other objects,
such as personal items on the bedside tables. Open all the curtains and
let the sunshine in. Flowers are always nice to have.
Bathroom
In the bathroom it’s preferable to put away any bottles, soaps, toilet
brushes and cleaning ducks and other things lying about. Remove as
much stuff as possible from around the wash basin and the edge of the
tub. New, clean towels give a welcoming look.
Storage room/Garage
Few Spanish homes have storage rooms, so if yours does, it’s very
important to show it. But please make an effort to make it look
organised a bit, you have to do this job anyway when you are moving
out, so start selecting what to save and what to give away and your
storage will look fab!
